By accessing or using ShotStudio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ShotStudio provides AI-powered e-commerce image processing services including but not limited to: image translation, background removal, smart cropping, and AI title generation. We reserve the right to modify, suspend, or discontinue the Service at any time.

2.1 AI Model Disclosure

ShotStudio utilizes the following AI models to power our image processing services:

  • RMBG-1.4 — For background removal and image segmentation
  • Qwen-MT-Image — For image translation and multilingual text processing
  • DeepSeek VL — For image understanding and content analysis

These models are operated by their respective providers. ShotStudio is an independent platform and is not affiliated with, endorsed by, or officially connected to any of these model providers.

3. User Accounts

To access our Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use

You agree NOT to use ShotStudio to:

  • Process images containing illegal, harmful, or offensive content
  • Infringe on intellectual property rights of others
  • Upload content you do not have the right to process
  • Upload images depicting minors or generate content involving children
  • Attempt to gain unauthorized access to our systems
  • Use automated bots or scrapers without permission
  • Resell or redistribute the Service without authorization

5. Payment Terms

ShotStudio offers one-time credit pack purchases, not subscription services. Payments are securely processed via Waffo Pancake, our PCI-DSS compliant payment processor, with Creem serving as our Merchant of Record (MoR) for compliance, tax collection, and billing management. By purchasing a credit pack, you agree to:

  • Pay the specified amount for your chosen credit pack
  • Provide accurate billing and payment information
  • Use your credits within 30 days of purchase
  • All payments are non-refundable except as outlined in our Refund Policy

6. Credit Packs and Usage

ShotStudio offers one-time credit packs (not a subscription service):

  • Each credit allows one AI image processing operation (translation, background removal, smart crop, or title generation)
  • Credits expire 30 days after purchase
  • Unused credits do not roll over after expiration
  • You may purchase additional credit packs at any time
  • There is no automatic recurring charge, subscription, or automatic renewal — each purchase is a one-time transaction

7. Account and Data Retention

Your ShotStudio account and any remaining credits will be retained as long as your account is active. If you delete your account:

  • Your account will be deactivated
  • Unused credits will be forfeited
  • Your personal data will be deleted within 30 days

8. Intellectual Property

Your Content: You retain all rights to the images you upload to ShotStudio. You grant us a limited license to process your images as requested by you.

Our Content: The Service, including but not limited to the software, algorithms, and branding, are owned by ShotStudio and protected by intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted or error-free
  • Processing results will meet your specific requirements
  • Any errors in the Service will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICMAGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ShotStudio and its affiliates from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or by posting a notice on our website. Your continued use of the Service after such changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.
